Enterprise Real Estate Dispute

As you will be aware, there has been a relatively protracted process with the Enterprise Real Estate Dispute- which if we lose, will see a number of employees’ positions being contracted out across various sites within Aurizon.

As many of you will know, the hearing date was set down for the 27 February 2014. This hearing did not proceed because the Commissioner was not happy with the question and wanted the parties to reconsider the question that needed to be answered.

We got that resolved and had a new hearing date laid down on Monday 24 March 2014. However, on Wednesday of this week, only 3 business days before the hearing date, the lawyers for Aurizon presented us with two new witness statements that we rightfully should have been presented with in December last year. This means that there’s more work to be done on our case and that we will not be ready to proceed to hearing on Monday next week.

The Commissioner has already vacated the hearing time and instead of a hearing, we will be having a teleconference to decide on a new date for the hearing.

We should know on Monday morning when it will actually go to hearing and we will make sure that all of your delegates and organisers are informed.

In the meantime, we continue with the status quo and it’s work as usual until we’re told otherwise.
